Hello, all!  Just wanted to give you an update to my job situation.   I posted recently about being on disability and getting the call that my position had been done away with.  (bank merger/buyout situation)   I have been at this company for 26 years!  Long story short, I made many phone calls.....just in case......to see if there was anything that I could do.  The result of all that was basically, if I had exhausted my FMLA time (which I had) there was really nothing I could do about it.   They do not have to hold a job for you even if the long term disability is approved as mine was.   THANK GOD.......my manager called me this week to offer me another position.....I will be in the same department - doing an easier job with the same pay.....works for me!!!!!!   Just wanted to let you all know that it turned out okay.   I feel like I can breathe again!   Thank you all for your support and suggestions.   Hope you all are doing well!   Take care.

That is great news.  It's so nice to know that there are still people out there who see other people as human beings with lives and not just dollar bottom lines.  Good luck!!

Oh! Congratulations! I'm so happy it worked out! If you recall, I mentioned that your situation is just about identical to a situation we had where I work.

The worker affected by the change who came back is still with us, likes her new job better than her old, and everyone's happy!

CONGRADULATIONS CAROLYN. I'M SO GLAD EVERTHING WORKED OUT FOR YOU!!! I GOT BACK TO WORK TODAY AFTER A BAD TREATMENT REACTION OVER THE WEEK END AND FOUND THAT I HAD BEEN LAYED OFF. IM OKAY WITH IT BECAUSE I HAVE TO BE BUT WHAT A BUMMER.

Natalie..is your place of employment laying off other people?  If you are the only person and it is not due to continued poor performance evaluations, there are lots of red flags...Going through BC Tx falls under the ADA (Americans with Disability Act).  I can share more info if you want/need it.

IT HAS NOTHING TO DO WITH PERFORMANCE ISSUES AND I'M ONE OF ABOUT 6 PEOPLE THAT HAVE BEEN LET GO. I BELIEVE THAT THE GUY I WORKED FOR THOUGHT IT WOULD BE AN EASY WAY OF GETTING RID OF ME. PLEASE DO SEND THE ADA INFORMATION I WOULD BE VERY INTERESTED.

Natalie, I am so sorry this happened to you.
It is illegal for you to be fired or laid off as a result of your treatments or missing work because of cancer.

Fight this!

You are covered under the American's with Disabilities act.

There is only one word to describe your legal ground:  DISCRIMINATION!!!!!!!!

Is Breast Cancer any different than being "dismissed"  for the color of your skin, sex, height, weight or any other physical challenge?  NO..

It infuriates me to witness exploitation by Employers who use CANCER as a way to dodge issues, neglect Employees, and disregard all avenues of human compassion  by squeezing blood from those who no longer fit into the "healthful company policy" thereby discarding the memory and remains of a viable, productive member of the team, and eliminating all traces that these people ever existed.  It is a strange and uncaring world most of us are thrust into without our knowledge; and when we are rudely awakened it is all too often, "too late". 

There are laws set in place to protect those who need to take protective measures regarding their health, wealth, livelihood and quality of life. We should all be fortunate enough to trust we are protected and secure in the benefits for being employed as a stable, reliable, and hardworking employee.  It saddens me to see this structure crumbling because of the corruption, greed, misguidance, and lack of compassion in the corporate world and beyond.

The construction of this nation is based on hope, trust, faith, compassion,  and security  for the lives of every citizen.  Embracing all possible connections, securing Legal Aid, and acting; without hesitation, you can only benefit from being pro-active.  Contact the legal aid provided by Social Services, and/or possibly the Legal Department in which you are employed.  I only know it is important to act on it NOW, rather than later...all too often the time limitations and legal constraints forfeit an employee's rights; their case is swept beneath the corrupt cooperative carpet and sadly forgotten.  Once the employee in "out of the picture" they are no longer a concern to anyone, they are "gone".  Who will care if you don't fight for your rights?  It sickens me to think about so many who have walked the corridor of  legal nonsense without protection, knowledge or help.  It is simply, WRONG. 

A lawyer and equal opportunities legal council may come in handy for what you need to protect yourself, right now!

Natalie - You sound resigned, I know how you feel - you have enough to deal with having f__k__g cancer and the toxic treatments that come with it.  You end up feeling like 'whatever...'
 
No fair to lay you off while you were out.  They are also laying off where I work.  My immediate boss called us all in today to tell us we are going to 32 hours to "keep the team together" instead of more layoffs.  However, if more work does not come in soon, he will have to lay some people off and he added that he "cannot consider personal situations, just the bottom line for the department."  I took it as a warning, because some people in my department are working on steady projects, and I am filling in.  I make up for it all by being cheerful as hell and helping out the bosses (layed off the secretary!)

THANK YOU ALL FOR THE CONCERN; THERE IS SO MUCH MORE TO THE STORY THAN  CAN TELL AT ONE TIME. YOU SEE I NERVER TOOK OFF FOR ANYTHING OTHER THAN THE SURGERY AND I WAS RIGHT BACK TO WORK BECAUSE I KNEW WHAT COULD HAPPEN. I HAD CHOSEN FRIDAY FOR CHEM DAY BECAUSE I KNEW I WOULD NEED THE WEEK END TO GET IT TOGETHER AND I DID NOT WANT PROBLEMS. I AM VERY OUTSPOKEN AND THIS GUY DOESN'T CARE FOR THAT IN A WOMAN. HE HAS SAID SOME NASTY THINGS TO ME DURING THE DIAGNOSIS AND TREATMENTAND SINC ETHE COMPANY WAS LAYING OFF AND HE WAS PART OF THE COMMITTEE CHOSING WHO WOULD BE LET GO WHAT BETTER WAY TO GET RID OF ME WITHOUT WORRING  ABOUT REPERCUSSIONS ?  AFTER AL THE COMPANY HAD TO LAY OFF RIGHT???? I KNOW I'VE BEEN SCREWED I JUST NEED TO FIGURE OUT WHAT TO DO ABOUT IT.

I'm still taking it all in and trying not to get depressed in the process. I'm sure that when I start to look I'll find a job. I do business to business credit and collections so there is an entire gamit of opportunities that I'm sure will be available. It's just hard when you are trying to hold on and people just keep pecking away at you. But.... I will have 2 chemo's left after Friday and that is music to my ears. The other will have to wait. How are you by the way???

Thank you so much for asking. I am not going to fight the job but I am doing well at the end of my treatment. I go for #7 on Friday and have one more after that. I'm so excited.
